shop.homefans.net (the website) is owned and operated by or on behalf of Homefans LTD. When you place an order through this website, a sales contract will be executed between you and us, which will be governed by these Homefans Terms and Conditions.
Before you place your order make sure that you read these Terms and Conditions carefully and check that the details of your order are complete and accurate.
You will need to register to be able to access the services on the shop.homefans.net website. When you register your details online, it is your responsibility to make sure that the information provided is accurate and up to date. You are also responsible for maintaining your personal information via your online account as well as for keeping your password secret.
3. Purchase Terms
These Purchase Terms apply to all offers and sales contracts relating to the sale and delivery of products by Homefans. So you agree to these Purchase Terms, when you order anything from the website.
3.1 Requirements to conclude a sales contract
You have to be 16 years or older when concluding a sales contract. It is not possible to order Homefans products through our website as a reseller, only as a consumer.
3.2 How is the sales contract concluded with you
Orders on the website are subject to the required stock availability. Items added to your basket on the website will not be reserved for you, and are available for sale to other customers browsing the online store at the same time.
All orders submitted by you are subject to acceptance by Homefans. We may choose not to accept your order at our own discretion. Examples of when we may not accept your order could be:
* If we have reason to believe you are not over 16 years of age;
* If we cannot deliver to the address that was provided by you;
* The product shown on the website is not in stock;
* If we are unable to obtain authorisation of your payment;
* If shipping restrictions may apply to a Product; and/ or
* If Products shown on the website contain a manifest error such as being incorrectly priced or otherwise incorrectly described.
When you have placed your order via the website, stock will be reserved for your purchase. However, the sale will not be finalised until the order is dispatched, and payment is successfully concluded.
Once the order has been placed and the payment is succesfully concluded we will send you a confirmatione-mail. This holds your order number and the specifications of the products that were ordered.
When you place an online order through shop.homefans.net, you will be requested to provide personal and card payment details. We will perform a fraud credit check via our payment service provider Stripe, as part of the online transaction. By submitting a payment through shop.homefans.net, you are giving permission for us to carry out such checks via our payment service provider Stripe as required.
Once the payment is succesfully concluded and the product is shipped we will send you an e-mail with the goods that have been shipped and a track&trace code to check the status of your parcel. For more information on shipping and deliveries please check paragraph 8.
Finally we will send you a e-mail that holds the invoice for your order.
We recommend that you print or save these e-mails for possible future use.
3.3 Cancelling your order
As we start to process your order directly after the sales contract is concluded, it is not possible to cancel your order.
All prices on the website will be shown in Euro’s (EUR). Orders can only be placed and paid in Euro’s (EUR). We are unable to offer alternative currency pricing to any customer.
All prices on the website are including Value Added Tax (VAT).
Homefans holds the right to adjust, end or limit prices or special offers at any time. Homefans charges shipping costs.
5. Duty Delivery Paid
Any customs charges are not included in the entire ordering and payment process of shop.homefans.net. This means that orders outside EU may contain import duties. Please refer to the conditions in respect of import at your local customs. If for this reason the shipment is not accepted, we have to charge you by deducting the shipping costs on your refund.
6. Payment and order acceptance
We accept the following payment types on our site:
By submitting your order on our website, you are confirming that the credit/debit card is yours or that you have authority from the cardholder to make the payment. We reserve the right to refuse payments & orders for customers who are not 16 years of age or older.
We will process your payments securely via the Stripe payments system, and all payment details will be encrypted. All stored card details will be stored securely on Stripe’s secure servers.
Your payment and order will only be deemed as final when final payment is taken on dispatch of your goods. Credit card payments for all orders are taken on dispatch of goods, and are subject to fraud checks and checks by the card issuer. We reserve the right to refuse any payments or cancel orders at our own discretion as stated in paragraph 4.2.
If your order has shipped, you will receive a delivery confirmation e-mail with the tracking number and a link where you can track&trace your parcel. Some e-mail providers may route Homefans e-mails to your spam or junk folder. Be sure to check these folders if you do not see the e-mail in your inbox.
Change shipping address
We cannot change the shipping address or shipping method at any time after the order is shipped. If the package will not reach you because of an incorrect address, it will be returned to us as undeliverable.
8. Returns and exchanges
If you are not fully satisfied with your product, you have the right to withdraw from the sales contract. In other words, you have the right to return the product as indicated below, and we will ensure that you obtain a refund.
Simply follow the guidelines explained in the following section:
Subject to the provisions of these Purchase Terms, you may return the Standard Products received without a specific reason within 30 calendar days from the day you receive the standard product.
If you would like to withdraw from the sales contract with Homefans, reach out to us.
To exercise the right of withdrawal, you must inform us online by using the retour option in your Homefans account. When you have specified the product you would like to return we will send you a return form. This must be added to the return shipment.
If the return falls outside of the 30 calendar days, or the item is worn beyond normal use, damaged or not in its original packaging, Homefans cannot accept the returned items and cannot give a refund. Clothing returns can only be accepted if the original label or hangtag have not been removed and when the product is packed in the original packing.
Please follow the return instructions which are on the return form. You are responsible for the return shipment, Homefans can’t accept any responsibility or liability for misdirected or lost shipments. We recommend you to use a traceable shipment.
When we receive your return and it is according to the above stated conditions, Homefans will refund the purchase price. This will be done within fourteen days after a notification that you wish to exercise your right of withdrawal has been received by us. Please note that we will only become obliged to reimburse you when the product(s) has been physically received by us. Once the return is received by us we will notify you via e-mail.
As you will return the product to our return address yourself, the duration of time that the product is in transit is beyond our control. When we have received your return we will process it as quickly as possible. Please allow at least 14 days to receive and process your return. We will strive to reimburse you within two working days after physically receiving your return. Please allow your bank or credit card company additional time to process your refund.
If a Standard Product is returned and Homefans believes that it has been damaged because of an act for which you are to blame, or which is otherwise for your expense and risk, Homefans will be entitled to deduct the decrease in value of the returned Product as a result of this damage from the amount to be repaid to you. You can avoid the obligation to compensate the decrease in value of a Product caused by use by not using the Product and by refraining (as far as reasonably possible) from any actions that could negatively affect its value.
Homefans does not exchange Products. If you wish to exchange a Product, you will need to return your purchase for refund and place a new order. It is only possible to get a refund on returns when the return is in line with our return policy.
9. Other important issues
Intellectual Property Rights
Usage of shop.homefans.net grants you no rights to any copyright or intellectual property rights relating to the content of the site. All copyright and trademarks are protected under national and international law.
Any site content can only be reproduced or distributed with express permission from Homefans.
These general conditions and all disputes arising in connection with these general conditions, including the validity thereof, or with the use of the Website(s) or with any purchases on the Website shall be governed by UK law.
Amendments on General Terms and Conditions
We may revise these general conditions at any time. Every time you order products from us, the general conditions in force at that time will apply to the contract between you and us.
